Hiring contract staff is massively changing on 6   April 2021. The IR35 legislation is now moving into the private sector. The new legislation aims to ensure that workers who are operating through personal service or limited companies are paying the right levels of tax and national insurance.

There have already been reports that major employers such as Barclays and GlaxoSmithKline have told their contractors that they will only hire them as ‘on-roll’ employees as they prepare for the new legislation next year.

1) WORKFORCE ANALYSIS – FULL CONTRACTOR ESTATE AUDIT

To complement the raw workforce data, companies will now have to review and assess each assignment to understand the implications, including assignments which are in scope of the IR35 legislation.

2) ACCURATE SDS (STATUS DETERMINATION STATEMENT) REPORTS

As an employer, it will now be your responsibility to provide detailed and accurate SDS reports to the whole supply chain which can be a huge administrative burden.

3) INSURANCE: IR35 COVER FOR EACH INDIVIDUAL CONTRACTOR

To provide reassurance, we will arrange full insurance for each individual contractor working onsite through us. We will be using a first-class IR35 specialist Insurer backed by Zurich and DWF. Our insurance will make sure that you are fully covered against any financial or
criminal risk.

The insurance that we will provide will cover each individual contractor for a 4-year period (even if they have left the project) up to a value of £100K for legal expenses and £100K tax bill, per contractor.

4) SUPPLY CHAIN COMPLIANCE

To stay compliant, S-SA will ensure full visibility of the entire supply chain to reassure every member involved, including you, us and the contractor is complying with IR35. The responsibility to ensure supply chain compliance will now fall with the end client which will reduce any risks to you.
